This is the aftermath of the meeting with our lawyers, Richard Close and Suzy Forbath, of Gilchrist & Rutter. Paul Goldstone was also present.

Terry Hancock was present. He merely observed while the attorneys and Goldstone were speaking.

His first statement was to the effect that he heard some things that were true, some evasive and some were simply non-responsive. They focused entirely on what might be good and avoided any subjects they considered bad. El Dorado was mentioned, speaking about how it was an improvement to have lower density in the park. This is due to the fact that many spaces are empty as a result of the conversion and the homes were removed. Terry says it is not a generally shared opinion that mobile home parks are more attractive when many of the spaces are empty. They evaded the question of how many people in El Dorado left because they couldn’t afford to buy. What happened to those people? The truth of the matter is that no park wants to have vacant spaces. It’s an eyesore and they don’t want that.

The spaces orginally sold for $88,000 and now are selling for $135,000 to $175,000. One question is whether the spaces were worth $88,000 when they were originally sold. In several parks that were purchased by the residents they didn’t pay anywhere near that price. If you speak to the people at Palm Terrace and Turner Lane, $88,000 would be considered a very high price for this type of purchase. Another issue for those who didn’t/couldn’t buy at El Dorado. If they should attempt to sell their home, that $50,000 will have to come from somewhere because the space now costs $133,000. For those that didn’t buy, they will lose equity from their residence.

He thinks most of us would agree with their statement that home ownership is usually a good investment in both your life and your finances. In this scenario the question is, “At what price? What are the details?”

Part of their discourse included the statement that it doesn’t matter if 100% are against the conversion; it’s going to happen. Their declaration was to the effect that no matter how long it takes, it would happen eventually. That’s not necessarily true. Terry is confident that in their private conversations with the owner the attorneys don’t tell him that, either. They don’t tell him that because, in fact, it’s not that clear. If you look at the ordinance that the county has established it won’t be approved if there isn’t enough support. But, he states that he can’t unequivocally tell us that we will win, either.

It is unknown why the governor vetoed AB 1542. But, he won’t be the governor forever! ( we know now view his veto statement)

Voting yes or no on the survey, a couple of things that Suzy said about this were inaccurate. She said they were prevented from providing a cover letter with the survey that they mailed out. That was not true. We didn’t even know it was coming, how could we have prevented them? That statement was absolutely made up.

She further said how critical the demographic survey was for the end result. If it was so crucial, then why didn’t someone tell Terry? He had conversations with their other attorney and it was never mentioned. He doesn’t believe that to be true, either.

The lower income state funding was mentioned by Suzy. That has been discussed in the past and those funds are limited. Goldstone said that he would consider financing some of the lot purchases in the park.

Terry brings up the issue of the survey again. They stood there and told us that the survey was not going to make no difference at all. If it doesn’t matter, then why do we have to do it? Suzy said that by the next week they would be sending the survey out.

Why do they care so much if we support them? Hypothetically, if we should vote to have a majority vote to support the conversion, what incentive does the owner then have to improve any of the conditions of the park?

Goldstone saying that we have no control over this matter is simply not true. It’s intended to steamroll us. They tell us we have to vote within a week without knowing what the price will be, what the incentives will be. It certainly matters under the county ordinance, whether it will matter under the state statute remains to be seen.

The present state in the park of being unable to sell your home as a result of this will probably continue to be true. This could take a long time.

They didn’t mention the situation in Sonoma. It’s fact that the county ordinance can’t override the state bill. However, the judge in Sonoma decided that the county ordinance could be upheld. Both Sonoma and Santa Cruz have enacted their ordinances in order to fill in the gaps in the state bill, to encourage bona fide conversions.

Someone asks if he could just sell the park out from under us. Terry believes that if he could have done that and made more money at it, he would already have tried. People are obviously still concerned and intimidated by this situation. All we can do is keep up the status quo and keep on going.

Terry Hancock is present for the meeting. Tim introduces Terry to the group. He asks for everyone to turn in the questionnaire that was distributed to the residents for the parks failure to maintain. They have sent in at least 50 already.

Angela mentions the demographic survey. Terry talks briefly about the one that he is creating. Angela was referring to the one that the residents received in the mail from Gilchrist asking about occupancy and income in each space. Terry brings up issues of privacy. Why should the park residents have to give them their personal information? Gilchrist made the deadline for submitting the survey October 5 th. This really didn’t give anyone much time to get it back to them, since they were only received last week. Terry says this is a deadline that they made up; we are not required to respond to it. Must the residents respond at all? Terry says he doesn’t think so; neither the ordinance nor the statute requires it. A section of the newly enacted county ordinance may require this information. It says that part of the submission of the application by the owners must provide an estimate of these demographics in order to determine how many households fall under each category. If we don’t respond they could argue that we have refused to comply with the ordinance. They could also make something up.

He does state that it would be good information for each side. We don’t have to provide them with specific details of who are the lower, moderate or higher income residents. They need statistics; what percentage of the residents fall under each of these three categories. The survey that Terry is working on was going to contain this information.

Terry suggests that instead of sending the surveys to Gilchrist they should be completed and submitted to his office. He will write a letter to advise Gilchrist that this is how we intend to proceed. Everyone will have the choice of either completing the form and mailing it to his office or giving the completed form to Angela and she can mail it in for him or her. Clay expresses concern about how to explain all of this to the residents that aren’t present. Having more than one survey can be confusing and how will they know which is the correct one to complete? We’re hoping that the word has been sufficiently circulated that no one will complete any paperwork without consulting either Angela or Clay. As long as everyone knows to submit them to Terry or Angela their personal information won’t get into the lawyers hands.

Questions asked:

  1. I filled out a lot of paperwork when I first moved into the park, couldn’t they use that? Terry says that this may no longer be accurate if a person moved in a long time ago.
  2. Could the survey be filled out anonymously? This wouldn’t work because they probably wouldn’t count those at all. The rational could be that anyone could be submitting this form. He wants to be able to say that the statistics that he is providing represents however many spaces that have responded, he knows who submitted them and he only took one from each household.
  3. We’re supposed to fill this out and either give it to you or Angela? Terry responds that he is simply making suggestions for us.
  4. Couldn’t we just lie about the information? Terry says that he would definitely not suggest that anyone put anything untruthful on the form. He feels it would be inappropriate to do this.
  5. Can the lawyers use the fact that we didn’t return the survey by October 5 th against us, saying that we didn’t cooperate? The first time they came to the park was the same, they only gave us a few days notice. Terry says his response will be that we didn’t receive any notice, the time limit was unreasonable and arbitrary, legal time limits appear nowhere in the ordinance.
  6. When we give the surveys to Terry, is he going to send them to the attorneys? He says no, he won’t just copy and forward them. He will take the information and compile the statistics and forward that to the attorneys. Under the basic rules of civil litigation both parties can demand and often obtain documents, records and things like that. He will guarantee that he won’t give it up freely. He would only divulge any of this to the Gilchrist by court order.
  7. If people mailed the surveys to the attorneys, what can we do about that? There is nothing that can be done, if some have already sent their survey to Gilchrist. That is their choice. He will ask Gilchrist to give him copies of what they have received.

The survey information is being compiled in order to comply with the ordinance. In case it should go far enough those statistics would be required to determine benefits, penalties, etc. that would be attached to each household. Goldstone is threatening to bring the lawsuit against the county for the ordinance and may simply be utilizing it in order to get these demographics.

The attorneys for Gilchrist and Rutter have accepted our invitation to speak and answer our questions at the next meeting, which will take place on Monday, November 5 th, 2007.

Tim begins the meeting by talking about the ordinance that the Board of Supervisors is going to vote on tomorrow. Everyone is encouraged to attend the meeting. Each person is entitled to 3 minutes on the podium and can make their appeal on why we don’t want the conversion to go through. The meeting starts at 09:00 am. Even though we’re not the first on the agenda it will be a good idea to be there from the beginning. There’s no way of knowing how fast they will get through the other issues.

Goldstone has filed a lawsuit against the county for $15,000,000.00 for the moratorium and the ordinance. It’s very important to let the board know that we how much we appreciate their efforts on our behalf. We did have a good response at the meeting. There were also people from other mobile home parks and Terry Hancock and Will Constantine spoke for us.

One person who works for the county mentions that the S.E.I.U. labor union is going to be present and may slow things down. They have issues they want to present to the board and there might be quite a few of them present. As it turned out, there weren’t that many.

Tim proceeds to talking about the survey. When it is completed and mailed out it is very important that it demonstrate the way the park residents feel about the conversion. Terry Hancock is working with us for the wording and format that we wish to have on the survey. The homeowners association is supposed to be able to review and approve what the owners will send to the residents. We’ll see just how cooperative they are.

Are Gilchrist & Rutter still calling the residents? One person mentions that they left her a phone message.

Angela reads the email sent to Casparian by Terry Hancock. It mentions the survey and the fact that the application to convert the park can’t be completed until the survey has been submitted. He goes on to say that the residents association remains willing to work with you to create a fair and workable survey.

He mentions again that the homeowners association represents the park residents and that his law firm should not be contacting the residents individually. As reported to him their representative contacted at least one park resident solely about the proposed conversion. Such contact is clearly prohibited by rule 2-100 of the rules of professional conduct. Please advise your employees to refrain from making further contact with the residents.

Reference to the misrepresentation of the homeowners association. Terry says he has requested that the attorneys meet with us at a mutually agreeable date and time. At that meeting they may explain the conversion to all of the persons present. As part of preparation for this meeting we would like them to provide us with written answers to questions that would be distributed at the meeting.

Clay provides us with some copies of the lawsuit and the proposed ordinance. What does the survey mean? What the board has done with the ordinance is to define what the survey is and what a bona-fide vs. non bona-fide conversion is. It further states that there must be a 50% vote or better in support of the conversion to determine whether it will be approved. The subdivider shall bear the burden of demonstrating that it is a bona-fide conversion. Someone asks if the board is in favor of passing the ordinance. They have worked hard on getting the ordinance created and passed and seem to be in favor of it. It calls for full transparency in the conversion.

Clay is very enthusiastic about the overall wording of the ordinance. They put a lot of work into it.

The meeting on August 7 th went very well and the ordinance was passed.

Assembly Bill 1542 is still there, the state budget is the main concern in the Capital at this time. Send your letters in to the governor asking him to support and sign this bill.

Management is harassing some of the park residents. Angela got a letter that she should stop construction on her home immediately. When she asked Maxine about it, she had no idea what it was about. Clay has been subject to harassment. Another person who was trying to sell her place had the deal fall through because of the way the prospective buyer was treated by the managers. Denise reads a letter someone received from Cathy telling her to remove her deck, as it is on park property. That if she doesn’t remove it the park will and she will be billed for it. Anyone who receives something from management should respond immediately and keep everything they get.

There is going to be a meeting of the Board of Supervisors on August 7 th in the county building, 5 th floor. These meetings usually start at 0900; there will be further information on the exact time later. They are going to discuss an ordinance that will be written to protect the residents of mobile home parks without giving the owners any angles to sue the county. Everyone at our meeting is encouraged to attend. Each person will be allowed 3 minutes to speak. Be prepared; don’t walk in without knowing what you are going to say. They are very strict about the 3-minute time limitation. We must make it very clear to the board how we feel about this park conversion. Maybe we can do some carpooling for the meeting; parking can be at a premium at the county building.

Richard Close filed the papers with the county regarding the conversion, but nothing can proceed without a completed survey by the residents of the park. We now have 91% of the residents against the conversion; including one person who believed the park had our best interests at heart. The question comes up again whether we should put a survey together. Terry has advised against that, he says to let them provide us with one that we can choose to accept or reject. Most important will be for us to fill out the survey in a uniform manner, once we have accepted one. We can have an emergency meeting and have everyone agree on how to respond. Should anyone get one they should contact Angela or Tim right away. All parks that failed had a survey that indicated they were in favor of conversion, whether intentional or otherwise.

The owners believe that rent control will eventually go away and they will be able to ask whatever rent they want for the spaces. This was brought up at one of the meetings when they were complaining of all the money they must spend on park maintenance. When we offered to buy the park they said Paul would never sell to us. He is willing to wait this out, in anticipation of laws changing or a successful lawsuit to abolish rent control.

How many residents have gotten phone calls from persons representing the park? The attorneys are attempting to determine whether people are in favor of the conversion. About 12 people raise their hands. One lady says she hung up on them. Terry sent them a letter asking them to refer all information to the board that is representing the park. Tim reads the letter out loud to the group.

The statuses of the assembly and senate bills we are most concerned about are mentioned. The understanding is that SB 900 was temporarily pulled since the key supporters for the bill were not present at the time. This is a normal practice in the senate.

The moratorium is mentioned and explained to the residents. While it is in place the board of supervisors will not approve any conversions. Our moratorium will expire in February 2008. If SB 900 is passed there will be no need for a moratorium.

Someone asks Angela if she will talk with the 9% in the park that have not agreed to sign the petition. She says she can’t do anything further, it could constitute harassment and that would not look good. If anyone else knows someone who is for the conversion, they could attempt speak with him or her about it if they wish. The people who aren’t signing haven’t come to the meetings, so they don’t really know what is going on. Besides, considering that we have 91% of park against the conversion, it really isn’t something we should be concerned about.

There is discussion about why it is more advantageous for the residents to purchase the park vs. being sold the land by the park. When mobile home residents purchase the park they would also get the value of their land if they should sell their home. The park owners can ask whatever they want when they choose to sell us the land.

The park is currently reclaiming land from some of the residents who had been told it was their responsibility. It’s believed that they are attempting to reclaim portions to be part of the common areas. They are also bringing the park up to code; one example is the parking outside of the manager’s office that is now marked “handicapped path”.

There is discussion about the eminent domain measure (Proposition 90) that was on the last ballot and was defeated by a very small margin. That measure was promoted and written by property owners that were attempting to get rid of rent control.

There may be some more options for financing if residents are interested in selling their mobile homes. There is one outfit in Fresno; no title of the business is mentioned. Bay Federal may not be the only option.

The G.S.M.O.L. is the Golden State Manufactured-Home Owners League. They have either promoted or co-sponsored most of the favorable legislation that has gone through Sacramento for years. The front page says, “Advocating for Homeowners Rights Since 1962,” that’s 45 years! The reason to join the organization is in order to give them more money to be able to continue their efforts to lobby in the capital for our rights. They can also provide us with legal advice and will support our efforts to fight the conversion.

The next meeting is on Monday, August 6, 2007. That is the day before the Board of Supervisors meeting at the county building.

The first meeting regarding Alimur Park conversion took place on May 7, 2007. The first priority was to elect board members. Nominations took place and park residents that were present voted for and elected the board members.

Someone asked if we are now qualified to represent the park. Yes, since the residents of the park elected the board they are now qualified to represent the park.

All persons in the park must be educated as to the seriousness of the situation. We need to as much participation from the residents as possible. Education is vital to ensure that all are aware of what the conversion entails. An article written by Jan Beautz was in the Mid-County Post on February 20, 2007. The article, “Issues of Importance for Mobile Home Owners”, details these sham conversions. We strongly encourage everyone to read this article. An important point is that the park owners can pretty much ask whatever they want for the land.

Three bills that everyone is encouraged to support to prevent this from happening over the entire state are:
Senate Bill 900-details?
Assembly Bill-number and details?
Assembly Bill 1542-Requesting that Government Code 77427.5 be repealed and Government Code 66427.4 be amended.

A petition was circulated at the May 7th meeting. It’s a statement by the park residents that the A.P.H.A. board may speak for them and that they are against the park conversion. As of May 11th the petition had about 118 signatures. With 147 homes that’s about 2/3 (66%) of the residents. In order to impress on the council members that we are very opposed to this conversion it would be best to have at least 90% of the park signed on.

Someone mentioned Vicky Campbell; she was involved in the Turner Lane conversion.

At the conclusion of the first meeting some residents asked Angela for the names of individuals who declined to sign the petition, in order to speak with and further educate them.

Are there any rules about saying no to park conversion? Someone said we could do the same as with elections, a sign in the window of your home.

Should we try to raise some extra money? A $3 donation at each meeting was suggested.

We offer our support and thanks to the council members for the moratorium against park conversions that exists in Santa Cruz County. This is in order to preserve affordable housing. Some park residents believe that this conversion will be advantageous. I certainly did, at first! That misconception must be dispelled. There are three residents who believe they will be able to get their equity out if they purchase their property.

The A.P.H.A. board met with Terry Hancock on May 11th.

Terry asks Angela & Clay if they have reviewed the draft letter. The letter is to advise the attorneys to deal with our group regarding the survey. Terry asks how long the homeowners association has been in existence. Angela says since approximately 1982.

Gilchrist & Rutter are going to provide all park residents with a survey regarding the conversion of the park. Angela and Clay are going to create a survey that will be sent to the firm. They prefer that the attorneys use our survey. Terry says that wording is very important. Residents in a park in Gilroy completed a survey that led the board to believe that they were in favor of conversion. Questions such as, “Would you like to own your land?” When they responded favorably it appeared that they were in support.

Half of the residents at El Dorado were against the conversion, that wasn’t enough. There must be either “yea” or “nay” votes. The judge in this matter threw out all of the undecided votes. We must be much more organized and proactive.

At the present time (someone named Close? Is he an attorney?) they are trying to convert a park in Sonoma. They have filed in court to remove the moratorium. If this is successful Santa Cruz could lift our moratorium and enact local ordinances to provide protection. This can be done on an emergency basis if necessary. It would ordinarily take a couple of months.

If the conversion should progress the planning commission is the first step. We would request that the conversion be declined. If they should turn us down an appeal costs $3,500. We could appeal to one of the board members to have a vote to waive the fee. It will be perceived as a problem if the planning commission doesn’t provide us with initial support. They will be watching to see what the state does with the state and assembly bills.

There are no hardship waivers at the court level; all fees must be paid.

Clay opened the meeting was opened at 7:05pm.

Malinda asked that after a year of holding the post of Secretary, she would like for someone else to step forward. No one volunteered and anyone interested should ask to be nominated at the next meeting.

Survey of Rule Change #1 (AP now is allowing kids 14 and over unsupervised by an adult in Pool Table room: Do residents want to open it up to kids under 14 with adult supervision?: 14+no supervision: -14: Supervised.) A suggestion was made to simplify the proposal: Kids under 18 need to be supervised when in the Poolroom. Tina’s motion was passed unanimously.

Survey of Rule Change #2 (AP now is allowing babies and toddlers in swim diapers in the pool:) 5 votes for vs. 4 against, most abstained. Proposed was the request to extend pool hrs till 9, or even 10 pm, and extending the months the pool is open, possibly year-round.

Re: Overnight visitor parking: Nora suggested that each resident have a guest pass for visitors to use in guest parking on a first come first serve basis. Motion to make a request for these passes, was passed unanimously. Tina motioned to request that guest new guest parking to be opened up in several suitable and underserved areas, and that recently deleted guest parking spaces be reinstated. This also had unanimous approval. (The potential spaces are next the fence near #100 and #93, and o the back road parallel to #239 and #222. There is also room for a couple of spaces near #101. The deleted spaces are across from the apartments) Each resident should still have parking at their own space to alleviate the need for visitor parking)

Re: Pet rules: Brenda stated that there is a regulation in the CA Code that cats cannot run free in mobile home parks. Christina motioned that pet rules at least be amended so that small creatures in tanks or cages not be counted toward the 1 pet=1 cat or dog rule, and that max. Dog weight should be raised to a more realistic 30 lbs for a 14 “inactive dog. Assent was unanimous.

Clay volunteered to present all requests in a letter, started with the managers, then the to the property management company, if no result, and the, if needed, to the owner. Colleen volunteered to put out the newsletter. Treasurer’s Report: $1321.17 in checking

Re: GMSOL membership: Malinda volunteered to distribute the membership forms.
This was a very successful meeting with great participation, and good flow of new ideas. The food was great, but we will not leave it again for last, but from now on will eat as we meet. The meeting was closed at 8:30pm. The next meeting is Monday, August 2nd, at 7pm, and the main agenda item is the progress on all these items in the minutes.

We did not have a quorum, but discussed all items anyway. Here is a Pet Rule Proposal for the management: Cats do not have to be leashed, but owners are still responsible to clean up all poop from all their pets, in other words: scoop your poop. Small pets in cages or tanks will not count toward the One Pet (=One Dog or Cat)

Rule. Also, 30lbs. Is more realistic for the limit on small dogs, as they get fat when they don‘t get to run around! We were also wondering whether the solar pool heating was going to be a pass-through.

Re Newsletter: No one volunteered, so we will ask again next meeting. We will have handyman referrals in the newsletter and also post it in the laundry room. Also Malinda had to resign as Secretary. No volunteers yet.

Cathy and Maxine generously answered our many questions and explained plans for a thorough landscaping clean up, solar panels for the pool. (Pass through?) And that kids 14 and under really have to have an adult supervising when in the pool, clubhouse, pool table room, or laundry area. The new hours of these areas are again expanded to 8am-8pm. There is recycling by the dumpster and the pool again, and the phone rings through when the office is closed. They are also still accepting applications for a weekend manager.

The president, Clay, opened the meeting at 7:58pm.

We, residents of Alimur Park welcomed Maxine and Cathy, our new Park Managers.

Re old business: We would like a consensus regarding a possible adjustment of pet rules, reflecting the unrealistic expectation of having cats walked on leashes etc. Pet owners are definitely responsible for the clean-up after their pets, and we would like to see dog walkers with poop bags.

Re Offer on the Park: It was turned down again, but we will do this every year to have a first chance…

Re Newsletter: No one volunteered, so we will ask again next meeting. We will have handyman referrals in the newsletter and also post it in the laundry room. Also Malinda had to resign as Secretary. No volunteers yet.

Cathy and Maxine generously answered our many questions and explained plans for a thorough landscaping clean up, solar panels for the pool. (Pass through?) And that kids 14 and under really have to have an adult supervising when in the pool, clubhouse, pool table room, or laundry area. The new hours of these areas are again expanded to 8am-8pm. There is recycling by the dumpster and the pool again, and the phone rings through when the office is closed. They are also still accepting applications for a weekend manager.

Treasurer’s Report: $1321.17 in checking, and the food at the potluck was excellent. Thank you, everyone, thank you Gary and Jeremy for playing the piano,
Christina, acting for the Secretary.

The president, Clay, opened the meeting at 7:04pm.

Mr. Priest has contacted the new owner Mr. Paul Goldstone by letter, once via Mr. Green, and once directly, but there has been no response. We discussed sending the new owner a copy of our upcoming quarterly newsletter, and inviting him to visit our next party.

Christina read the letter send to everyone by the County of Santa Cruz Redevelopment Agency about the construction of sidewalks on Soquel Drive and Robertson Street. She will go, and also will write a summary for the newsletter, but encourages others to attend as well on: 3/15/04 @7:30pm, @ Lighthouse Church across the road.

We discussed current Park issues such as the rat infestation, due to garbage left by #57 that we can do nothing about until the new owners take possession. The managers have set traps, etc.

The president, Clay, opened the meeting at 7:10pm.

The Holiday Party was a success. Sixteen residents attended, the elephant gift game and carols on the tenor saxophone were played. We discussed to plan more resident parties as the occasions arise. If you have a good idea for an event to raise GMSOL membership, contact Clay Butler: 477-9029, Space #66

We learned that the GMSOL is possibly hiking yearly membership fees from $20 to $30 so more money would be available for parks in need of legal help to survive.
Kathy presented her new listing in the park #37 for $65k. Clay offered space on the Alimur Park website for finding buyers. He mentioned that the website was attracting a lot of interest of residents in other park seeking advice on how to deal with park issues such as noise, how to go about buying the park.

Christina Barauskas, the treasurer, reported that our current bank balance remains $1336.36

Agenda: Hear suggestions of amendments for discussion with the new owner.

We welcomed 2 new residents into the AP/GMSOL, Mark and Jeremy and informed them about AP and the GMSOL. The following amendments for discussion with the new owner to Pet rules were proposed:

#1. The "1 pet rule" should be changed to "1 cat OR dog." (Small caged indoor creatures, such as birds, hamsters and fish should not be counted the same way.)

#2. Strike: "Cats must be on a leash." (Leash laws should only apply to dogs, because, unlike cats, dogs can bite people, and are easily trained to walk on a leash.)

#3. The weight limit of a dog will be 30 lbs. (30 lbs. is still a small dog.)


Kathy would like to ask the new owner: Would it be possible to up-grade individual homes to 50 Amps if the owner(s) was willing to contribute to the cost of upgrading.

Christina reiterated that maintenance issues such as forever failing telephone lines, repaving streets and carports, and quality of plumbing will also be brought up with the new owner.

Kathy motioned that we have a Christmas party and the motion was unanimously approved. The party will take place in the clubhouse on Monday 12/22/03 at 7pm.

We hope to exchange some "White Elephant" gag gifts. We will have snacks and hot cider, and hope to add a few pages of pictures to the Alimur Photo Albums which date back to the 50's.

Christina Barauskas, the treasurer, reported that our current bank balance remains $1351.77

and that we are still hoping to find 4 volunteers for Mark Olson to teach how to set up the AP shuffle board court.

Agenda: reacquaint and open floor to solve neighborhood problems

Our president, Clay Butler, opened the meeting on 11/3/03 at 7:15pm

We discussed the change of ownership of AP and the status of our negotiations to eventually buy the park. The new owner of the park is Paul Goldstone Jr. and we look forward to meeting him and creating a good owner/renter relationship.

Christina Barauskas, the treasurer, reported that our current bank balance is:$1351.77

We discussed future agenda items:

#1. Pet rules, and discussing these with the new owner.

#2. Maintenance issues such as repaving streets and carports, and quality of plumbing which should also be brought up with the new owner.

We asked that everybody bring 2 suggestions to the next meeting which is on 12/1/03.

Lastly, Christina brought up Mark Olson’s request for 4 volunteers to learn how to set up the AP shuffle board court. Mark is 98 years old, so please come forward soon.

Clay Butler, our president, called the meeting to order at 7:10 pm.

He summarized our meeting that morning with Tip Green , manager of Hillsborough Properties earlier that day. (Many of the same residents present tonight came at 11am as well.) He had studied the financial outcome of the pass-throughs charged to us each year and found that it could be an advantage to us if they could have paid off in a shorter period than the current 10 years, a county requirement. The manager had informed him that a change would possibly require approval of 100% of the homeowners, hardly practical given the small sum at present. Clay also proposed to Mr. Green that we be allowed to review proposed work in the park before it started, with the thought that maybe some work could be performed by homeowners in the business. Green agreed to meet with a (Capital Improvements) committee.

Clay suggested that we needed the following committees, he would oversee:

1. Capital Improvements Committee-- to consult with matters of electrical, plumbing, hill-side and landscape maintenance, and street improvement, etc. Those with expertise in any of these areas were urged to join. Sign-ups:

2. Buy the Park Committee--Turner Lane park, also owned by Hillsborough Properties, is 6 months into the process of acquiring their park. there is much help available from the parks that have gone through the process, from GMSOL, and from government agencies .Sign-ups:

A recent newspaper article was passed around re: rent control. (Why it should be abolished.) It contained some very scary statistics from around the country. Clay was pointing out that the most important bill that would help us, is the one that for the 3rd time again, did not make it this year, the one that would allow cities and counties to recover their legal fees if they win a (nuisance) suit against park owners. This ends up bankrupting cities and the cities give in, and end rent control. The latest we heard is that Rep. Sam Farr is taking this issue to Washington. Again it was stressed that personal letters, not petitions, to Sacramento count the most, So please study *The Californian” where current legislature is listed, and call the GMSOL Hotline, 4pm-8:30am: 1-800-888-1727.

Clay talked about the skateboarding issue: It seems to have been resolved after he asked for cooperation of the youngsters involved. We all want to live in peace and harmony. Kathy Davis offered to help with the copying of notices and newsletters. George Cardona thanked the officers for their work and suggested that if anyone disagreed, they should get involved themselves.

Monday, January 13, 2003 was set for our next meeting. The meeting was adjourned at 8:15 pm
There was an atmosphere on energy and enthusiasm at this meeting, as observed by Britta Zetterberg, Secretary. (The minutes were taken by Britta, and typed (adding a occasional clarification) by Christina Barauskas.)
